Terms and conditions of the "more SAFETY" competition

1 General information

The "more SAFETY" competition is organized by the pjur group Luxembourg S.A., 87 Esplanade de la Moselle, 6637 Wasserbillig, Luxembourg (referred to in the following as "pjur"). Participation is free of charge.

The competition is held on our website https://www.pjurlove.com/dealer-lounge/. By clicking on the icon [enter what this is called] on the homepage, users are taken to a landing page [enter subpage], where the competition is explained. To participate, users must send a picture to the email address win@pjur.com.

2 Duration of the competition and participation deadline

The window for submitting a photo opens on 1 July 2020 and closes on 31 August 2020 (11:59 p.m.). The closing date for participation is 31 August 2020. After this, pjur will randomly select the winning places 1 to 6 and the winners will be contacted by email within one week.

3 Qualifying entrants

To qualify for the competition, participants must be employees of commercial customers of pjur who are acting in the course of their professional duties and who are eighteen years or older. Employees of pjur and their relatives are not eligible to take part in the competition pursuant to Section 15 of the German Fiscal Code and are excluded from participation. Competition agencies and other automatically generated mass participation and bulk mailing systems are expressly prohibited and shall not be included in the prize draw. Any entrant who enters multiple times using different or multiple addresses and/or accounts or other manipulative measures shall be immediately disqualified.

4 Participation and prizes

4.1 During the period from 1 July 2020 to 11:59 p.m. on 31 August 2020, pjur will be holding a competition on the website www.pjurlove.com.

To take part in the competition, participants must submit a photo by email to win@pjur.com . Participants must send in a photo showing one or more employees (eighteen years or older) of a commercial customer of pjur wearing a pjur mouth and nose mask shown below:

A pjur product must also be shown in the photo.

Photos must be submitted between 1 July 2020 and 31 August 2020 (11:59 p.m.). The closing date for participation is 31 August 2020 (see Section 1).

4.2 After the participation cut-off date, pjur will choose an initial selection ("best of" selection) at its own discretion and in line with the criteria listed under Section 4.1. A final public vote will then be held, with the three photos that receive the most votes awarded places 1-3. pjur will upload the "best of" selection to the website www.pjur.com/vote for voting. A link is available on the website www.pjurlove.com/haendlerlounge/ that takes voters to the website www.pjur.com/vote, where they can cast their votes. Public voting starts on 31 July 2020 and finishes on 23 August 2020 (11:59 p.m.).

4.3 The individual winners (places 1 – 6) shall be informed via email by pjur within a week. Winners are asked to provide the following information by email to win@pjur.com within five (5) days of receiving notification:

If this information is not sent within the above-mentioned time frame, the winner is no longer entitled to their prize.

4.4 The object of the competition is to find the top three photos that receive the most votes. The following prizes will be awarded:

First to sixth place:

For the commercial customer of pjur:
144 x 100 ml of pjur products (chosen by the winner)

For the employee(s) of the commercial customer who took part:
12 x 100 ml of pjur products (chosen by the winner)

The pjur product prizes are sent by post.

5 Terminating the competition prematurely

pjur reserves the right to terminate the competition at any time without prior notification. pjur shall avail of this option, in particular, if it cannot guarantee that the competition will be executed properly due to technical reasons (e.g. viruses in computer systems, manipulation or faults in hardware/software) or for legal reasons.

6 Liability

Any claims for damages vis-à-vis pjur, its employees, agents and/or associated companies connected with the competition are excluded.

This does not apply in cases of wilful intent or gross negligence or breach of obligations enabling the fulfilment of the contract (cardinal obligations).

Furthermore, pjur, its employees, agents and/or associated companies accept no liability for damages or impairments (e.g. technical faults outside of its sphere of influence, force majeure events, faults caused by third parties) that affect the availability of the competition website. However, pjur shall make every reasonable effort to ensure that the competition website functions properly and reliably. pjur also accepts no liability for the competition website functioning properly on participants' computers. Furthermore, pjur is not liable for any data losses, in particular data lost during transmission, or for other technical defects or the correct transmission and/or sending of emails.

7 Rules governing personal rights, copyright and the content resulting from the creation of your video/photo

7.1 The photograph that you submit as part of the competition shall be used and published by pjur and/or the agencies commissioned by pjur CURE S.A., 3 Schaffmill, 6778 Grevenmacher, Luxembourg and D.I.E. WEBexperten UG Stiftsgasse 21-25 07407 Rudolstadt, Germany, on social media channels (facebook.com/pjurgroup, instagram.com/pjurlove) and on the pjur websites (pjurlove.com).

Please note the following rules:

7.2 If other people are shown in the picture along with the participant, you must inform them of the purpose of the picture and explain that it will be published on our social media platforms. Before you send us the photo, you must obtain these individuals' consent.

7.3 By participating in the competition, you agree to obtain the necessary consent (Section 7.2) from all persons named above. You must be able to show proof of consent to pjur at any time. If any persons shown, the creator of the photo or other third parties are entitled to claim compensation or apply for a cease and desist order against us pursuant to Sections 7.2 to 7.4, you shall release us from all of these claims, reimburse us for any costs for legal defence and for any other damages incurred by such a claim.

7.4 Photos with racist or sexist content, content that glorifies violence or that could be harmful to minors or any other illegal or inappropriate content are not permitted.

7.5 Photos will be checked by pjur before they are published. If there are any indications that a photo does not comply with the above rules, it will not be published. The participant shall be informed of this by email, stating the grounds for not publishing. pjur may give the winner the opportunity to address the concerns raised about publishing the photo, however, it is not obliged to do this.

8 Transfer of rights

By participating in the competition, the participant grants pjur, pursuant to Section 4, the non-exclusive right to use the photo submitted pursuant to Section 7.1 within the scope outlined in Section 7.1. The transfer of rights may be revoked. If the participant did not create the photograph themselves (selfie, self-timer), they must obtain permission from the photographer for the participant and pjur to publish the photograph within the framework of the competition. You must be able to show proof of consent to pjur at any time. If the creator of the photo or other third parties are entitled to claim compensation or apply for a cease and desist order against pjur pursuant to Section 8, the participant shall release pjur from all of these claims, reimburse pjur for any costs for legal defence and for any other damages incurred by such a claim.

9 Other information

9.1 Material prizes cannot be paid out in cash and are not transferable.

9.2 There is no requirement to purchase from pjur to enter this competition. Purchasing products from pjur has no influence on the chances of winning.

9.3 Participation in the competition and the resulting legal relationships shall be governed by the laws of the Federal Republic of Germany.

If individual provisions of these terms and conditions are or become invalid, this shall not affect the validity of the remaining terms and conditions of the competition.

9.4 The organizer's decision is final.

1.1 Use of data within the framework of the competition

Personal data will be collected from you for the purpose of this competition.

Personal data concerning participants will be collected, processed and used exclusively for the purpose of implementing the competition, identifying and announcing the winners and sending the prizes.

The following personal data will be collected within the framework of the competition:

Title, first name, surname, street, postcode, town/city, email address.

The legal basis for processing those data for the purpose of participating in the competition is your consent pursuant to Art. 6, Paragraph 1, Point a) GDPR.

You may withdraw your consent at any time by sending us a message to this effect. The withdrawal of consent shall not affect the lawfulness of data processing based on consent before its withdrawal.

Furthermore, data collection constitutes a legitimate interest pursued by pjur. The legal basis for processing data is Art. 6, Para. 1, Point f) GDPR. You have the right to object to your data being processed at any time. You can find further information about your right to object under Section of this data privacy statement.

The personal data of the winners shall be deleted two (2) weeks after the prizes have been sent.

10.2 Your rights

If your personal data is being processed, you are deemed to be a data subject according to GDPR and you have the following rights vis-à-vis pjur:

10.2.1 Right of access (Art. 15 GDPR)

You have the right to request confirmation from pjur as to whether or not we are processing personal data concerning you. If this is the case, you may request information about those personal data as well as other information set out in Art. 15 GDPR.

10.2.2 Right to rectification (Art. 16 GDPR)

If the personal data concerning you is inaccurate or incomplete, you have the right to obtain from pjur without undue delay the rectification and/or completion those personal data. You may also request that incomplete personal data are completed by providing a supplementary statement.

10.2.3 Right to erasure (Art. 17 GDPR)

You have the right to obtain from pjur the erasure of personal data concerning you without undue delay where one of the grounds outlined in Art. 17, Para. 1 GDPR applies.

Where pjur has made the personal data public and is obliged pursuant to Art. 17, Para. 1 GDPR to erase the personal data, we, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that you, as the data subject, have requested the erasure by such controllers of any links to, or copy or replication of those personal data.

The right to erasure does not apply to the conditions set out in Art. 17, Para. 3 GDPR.

10.2.4 Right to restriction of processing (Art. 18. GDPR)

Under the conditions set out in Art. 18, Para. 1 GDPR, you have the right to obtain the restriction of processing personal data concerning you.

Where processing of personal data concerning you has been restricted, such personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

If the restriction of processing pursuant to the above-mentioned conditions is restricted, you shall be informed by us before the restriction of processing is lifted.

10.2.5 Notification obligation (Art. 19 GDPR)

If pjur has rectified, erased or restricted the processing of personal data, we shall communicate this rectification, erasure of data or restriction to each recipient to whom the personal data concerning you have been disclosed, unless this proves impossible or involves disproportionate effort.

We shall inform you about those recipients if you request it.

10.2.6 Right to data portability (Art. 20 GDPR)

Under the conditions set out in Art. 20, Para. 1 GDPR, you have the right to receive the personal data concerning you, which you have provided to pjur, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller. Furthermore, you have the right to have the personal data concerning you transmitted directly from pjur to another controller, where technically feasible.

10.2.7 Right to object

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6, Para. 1, Point (e) or (f) GDPR.

pjur shall no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing; this includes profiling to the extent that it is related to such direct marketing.

If you object to processing for direct marketing purposes, your personal data shall no longer be processed for such purposes.

Right to withdraw the data privacy declaration of consent

You have the right to withdraw your data privacy declaration of consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

10.2.8 Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes GDPR.

The supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Article 78 GDPR.
